In March 2009, James Procter and Lisa Shyer successfully defended an alleged brain injury case. The plaintiff alleged that the defendant backed her vehicle into him while he was walking in a parking lot causing a serious brain injury as well as a knee injury. The plaintiff sought damages in excess of $900,000. Mr. Procter and Ms. Shyer presented medical evidence showing that the plaintiff was actually suffering from Alzheimer’s disease and did not sustain a brain injury as a result of the accident. The jury awarded the plaintiff only $40,000.
